Mr. Kurtz has had extensive litigation and transactional experience since commencing his practice in 1973. He has handled many sophisticated matters as special counsel for governmental entities and as litigation counsel for several major corporations. He has been awarded Martindale-Hubbell's highest rating (AV) to reflect his legal expertise, experience, integrity and overall professional excellence.
His experience encompasses many complex litigation matters, including cases presented to the United States Supreme Court invovling preemption of state laws regulating financial institutions. Further, as team leader of 10 attorneys and 9 paralegals, he was responsible for the prosecution of a highly complicated $400,000,000 case invovling the allegedly fraudulent misconduct of the former officers and directors of a large savings and loan association.
Mr. Kurtz has also prosecuted and defended actions on behalf of major motion picture studios and record companies involving copyright infringement claims and film distribution disputes. His experience extends to the successful handling of numerous partnership, libel, trade secrets and unfair business practices suits. He has frequently provided legal representation for the court appointed receivers of various types of businesses, including law firms, credit unions, money order companies, real estate developers and automobile delearships. Further, he has represented numerous residential homeowners in disputes with homeowners associations and others concerning landslides, slope failures, water intrusion, construction defects and expansive soil conditions.
In addition to his litigation duties, Mr. Kurtz has handled numerous real estate transactions and the purchase and sale of businesses. His substantial experience includes franchise acquisitions and the formation and operation of partnerships, limited liability companies, corporations, escrow companies and homeowners associations.
